Criminal Investigation at Gosport Hospital

Following the publication of a major report which found that more than 450 elderly people were given life-shortening opioid drugs they did not need at Gosport Hospital, it has been announced that Hampshire police and the Crown Prosecution Service are considering whether criminal charges should be brought against any of the medical professionals working at the hospital and responsible for administering the drugs.

It is likely that any criminal investigations will be centred around allegations of involuntary manslaughter which is killing without intent. This would include allegations of gross negligence manslaughter whereby the accused must owe the deceased a duty of care. This will almost always be the case in a medical professional/ patient relationship.
