Our client was alleged to have been one of three men who beat a man outside a pub but said that he was mistakenly identified by the bar staff who knew him and that he was not even there on that night. He had many convictions for violence and was the brother of the principal alleged assailant, who admitted being present but denied committing any violence.
A proper analysis showed that the police investigation had been flawed and there was the serious danger of a mistaken recognition by the eye witnesses. The jury unanimously agreed and he was found not guilty, despite finding his brother guilty.
