OBS client cleared of serious assault
No evidence was offered by the Crown Prosecution Service today in the case of a serious assault. Oliver Kirk was instructed by Kim Evans to represent a client accused of stabbing the complainant with a broken bottle, causing an arterial bleed.
Oliver Kirk robustly resisted an application by the Crown to admit the complainant’s evidence as Hearsay, when the police lost contact with her. A Defence Case Statement was prepared with the Client, which resulted in ongoing disclosure being provided by the CPS. This disclosure showed that the complainant had made a very similar false allegation in the past, resulting in the case being dropped at court today.
Kim says, “In every one of my last three cases, despite me writing to the CPS and asking for them to review the evidence, the prosecution has been dropped at court. It’s very frustrating, but ultimately we achieved the right result for our client”.
